Parent / Guardian Tutoring Service Agreement

This agreement is between Tutor on Wheels, represented by Abegail Castillo, LPT ("TOW"), and the parent or legal guardian ("Parent") enrolling a student. Platform bookings include centralized payment records, tutor verification, support, progress records, and reasonable replacement assistance. These benefits depend on keeping scheduling and payments within Tutor on Wheels.
1. Service
Tutor on Wheels ("TOW") provides tutor matching, booking administration, payment collection, scheduling support, progress records, and tutoring services through independent tutors. TOW will use reasonable care in matching, verification, support, and issue resolution, but educational results also depend on attendance, student participation, home support, accurate information, and the suitability of the agreed plan.
2. Tutor Selection and Replacement
The Parent may select an available tutor or request TOW to recommend one. Tutor profiles and documents are reviewed based on TOW procedures, but no verification can eliminate all risk. If a tutor becomes unavailable or a reasonable suitability concern arises, TOW may offer another tutor, reschedule, credit, or refund the unused affected session, subject to availability and the circumstances.
3. Fees and Centralized Payments
All tuition, booking fees, package renewals, transport fees, additional sessions, and other approved charges must be paid to TOW through the stated payment method. Payment directly to a tutor is not recognized as payment to TOW unless TOW authorized it in writing. A booking is not fully confirmed until payment requirements and tutor acceptance are completed. Prices shown to the Parent are all-inclusive except clearly disclosed travel, gateway, or special-service charges.
4. Trial Sessions
Trial sessions are paid sessions. The tutor is compensated for the trial, and TOW retains a platform amount for matching, administration, support, and processing. A trial does not guarantee that the same tutor or schedule will remain available unless a regular package is confirmed and paid.
5. Scheduling, Attendance, and Location
The Parent must provide an accurate schedule, address or online access information, student needs, and a safe, appropriate learning environment. For face-to-face tutoring, a responsible adult should know that the session is occurring and should remain reasonably accessible. The Parent must not require the tutor to perform unrelated childcare, transportation, household work, or services not included in the booking.
6. Cancellation, Rescheduling, and No-Show
Unless a package states otherwise, requests made at least 24 hours before the session may receive one reschedule credit subject to tutor availability. Late cancellations and no-shows are normally charged. If the tutor cancels, TOW will arrange a reschedule, replacement, credit, or refund for the affected unused session. Approved credits are not cash unless TOW expressly states otherwise and may have an expiry date.
7. Online Technical Issues
The Parent will provide a suitable device, internet connection, quiet area, and required learning materials. The parties will attempt to reconnect when technical issues occur. If a substantial portion of the lesson cannot be completed for reasons beyond the student's or tutor's reasonable control, TOW may extend, reschedule, or credit the affected portion after review.
8. Student Conduct and Safety
The Parent will inform TOW of relevant learning, behavioral, accessibility, allergy, medical-emergency, location, or safety considerations necessary for the session, while limiting disclosure to what is reasonably needed. Students must treat tutors respectfully. TOW may pause or end a session where there is violence, harassment, unsafe conditions, serious disruption, intoxication, illegal activity, or inappropriate conduct.
9. Progress and Educational Results
Tutors may provide session reports, recommendations, practice work, and progress observations. These are educational support records, not medical, psychological, legal, or formal school assessments unless expressly provided by a qualified professional under a separate arrangement. TOW does not guarantee grades, admission, promotion, examination scores, or a particular learning result.
10. Privacy, Communication, Photos, and Recordings
TOW and tutors may process Parent and student information for matching, tutoring, scheduling, payment, safety, support, records, and legal compliance. The Parent must not secretly record, post, or commercially use a tutor's image, voice, lesson, or materials. TOW will request separate permission for optional marketing photos, videos, testimonials, or public posts involving a child. The Parent should use official TOW channels for payment and important booking changes.
11. Non-Circumvention
During the enrollment and for twelve (12) months after the last TOW-booked session with a tutor introduced by TOW, the Parent must not directly or indirectly hire, pay, renew with, or arrange tutoring or related services with that tutor outside TOW without prior written consent. The Parent will refer any direct proposal back to TOW. This protects the verification, support, replacement, and record-keeping system and will be interpreted only to the extent reasonable and enforceable under applicable law.
12. Refunds and Credits
Refunds or credits depend on unused services, the cause of cancellation, package terms, discounts, completed matching work, payment charges, and applicable law. Completed sessions are generally non-refundable. When TOW approves a refund, the refund method and timing may depend on the original payment channel. Any lawful consumer rights remain unaffected.
13. Complaints and Disputes
The Parent should report concerns promptly with the booking date, facts, and requested resolution. TOW may review messages, reports, attendance, and relevant evidence. The parties will first attempt good-faith resolution through TOW's complaint process, then mediation or other lawful remedies if necessary.
14. Termination
The Parent or TOW may end the service, subject to payment for completed or properly chargeable sessions and resolution of unused prepaid sessions under the package and refund rules. TOW may immediately suspend services for non-payment, fraud, unsafe conditions, harassment, misuse of personal data, direct payment to a tutor, bypassing the platform, or serious policy breach.
15. Governing Law and Electronic Acceptance
This Agreement is governed by Philippine law. Venue and jurisdiction provisions should be finalized by Philippine legal counsel based on TOW's registered business address. Electronic signatures, checkbox acceptance, and electronic records may be used to the extent permitted by law.
16. Entire Agreement
This Agreement, enrollment summary, invoices, booking confirmations, privacy notice, cancellation/refund policy, and child-safety rules form the complete service terms. If a provision is invalid, the remaining provisions continue. Updated terms apply only after proper notice and acceptance where required.
Parent / Guardian Acknowledgment
By registering and booking on Tutor on Wheels, the Parent confirms authority to enroll the student, confirms that the enrollment information is accurate, and agrees to keep payments and arrangements within Tutor on Wheels.
